Camp and Recreational Program Terms and Conditions
These Terms and Conditions govern participation in any camp or recreational program (the “Program”) offered by InnovOak School Inc. (“InnovOak”, “the School”, “we”, or “us”).
By registering a participant for the Program, the parent or legal guardian (“Parent/Guardian”) agrees to the following terms.
1. Nature of Program
Camp programs offered by InnovOak are optional extracurricular programs and are separate from the School’s academic enrollment programs.
Participation in the Program does not constitute enrollment in the School’s academic program and does not create any ongoing educational obligation beyond the scheduled Program period.
2. Eligibility and Conduct
Participants must generally be at least four (4) years of age at the start of the Program.
Certain Programs may require participants to meet additional or different eligibility criteria, including age ranges, grade levels, or skill prerequisites. Where specific eligibility requirements are stated for a Program, those requirements shall prevail over the general minimum age requirement stated above.
InnovOak reserves the right to verify eligibility and to cancel or deny participation where eligibility requirements are not met.
Participants are expected to behave in a respectful and safe manner.
InnovOak reserves the right to remove a participant from the Program where, in the School’s reasonable judgment: behaviour poses a safety risk, behaviour disrupts the program, participants fail to follow staff instructions, participants damage property, participants engage in bullying, harassment, or unsafe conduct.
Removal from the Program for conduct or safety reasons does not entitle the Parent/Guardian to a refund.
3. Supervision and Attendance
Participants are supervised by Program staff only during scheduled program hours and before or after care period (if applicable).
Parents/Guardians are responsible for: before the official start time, after the scheduled end time, and during transportation to and from the Program unless transportation is specifically provided by the School.
Parents/Guardians must ensure timely drop-off and pick-up. Late pick-up may result in additional fees.
Participants will only be released to a Parent/Guardian or an individual authorized through the registration process or other procedures established by the School.
InnovOak may verify the identity of individuals dropping off or picking up participants through measures including, but not limited to: checking government-issued identification, scanning a uniquely assigned code or digital authorization credential, other identification or verification methods deemed appropriate by the School.
InnovOak reserves the right to refuse release where staff reasonably believe the safety of the participant may be compromised.
4. Health Disclosure
Parents/Guardians must disclose all relevant medical conditions, allergies, health concerns, and behavioural or developmental needs that may affect participation at the time of registration.
While InnovOak will make reasonable efforts to support participant health and safety, the School cannot guarantee accommodation of all health conditions, medical needs, or support requirements.
If InnovOak determines that a disclosed condition cannot be safely accommodated within the Program environment or available staffing resources, the Parent/Guardian will be notified and the registration will be cancelled with a full refund issued.
5. Medication and Emergency Authorization
Medication will only be administered if: written authorization is provided by the Parent/Guardian, medication is clearly labeled and provided in original packaging, appropriate administration instructions are provided.
InnovOak reserves the right to decline administration of medication where adequate information is not provided.
In the event of illness or injury, Parents/Guardians authorize InnovOak staff to provide basic first aid and to seek emergency medical care where necessary, including contacting emergency medical services if a Parent/Guardian cannot be reached. Any resulting medical expenses remain the responsibility of the Parent/Guardian.
6. Assumption of Risk
Parents/Guardians acknowledge that participation in camp activities involves inherent risks, including but not limited to: sports and physical activities, outdoor recreation, playground activities, field trips or off-site excursions, interaction with other participants.
By registering the participant, Parents/Guardians voluntarily assume all risks associated with participation, including the risk of injury.
7. Release and Waiver of Liability
To the fullest extent permitted by law, the Parent/Guardian agrees to release and hold harmless:
InnovOak School Inc., its directors, officers, employees, staff, agents, contractors, and volunteers
from any and all claims, liabilities, damages, or expenses arising from participation in the Program, except where such loss results from gross negligence or willful misconduct.
8. Indemnification
Parents/Guardians agree to indemnify and hold harmless InnovOak from any claims, damages, or expenses arising from the participant’s conduct, damage caused by the participant, failure to disclose relevant medical information.
9. Personal Property
Participants are responsible for their personal belongings. InnovOak is not responsible for loss, theft, or damage to personal property brought to the Program. Parents/Guardians are encouraged to avoid sending valuable items.
10. Property Damage
Parents/Guardians may be responsible for the cost of repair or replacement of property damaged by the participant during the Program where such damage results from the participant’s actions.
11. Photography and Media
InnovOak may photograph or record participants during Program activities for purposes including school communications, promotional materials, marketing, website and social media.
By registering for the Program, Parents/Guardians acknowledge and agree that such images or recordings may be used by InnovOak.
12. Payment and Registration
Full payment is required at the time of registration unless otherwise specified.
Registrations are considered confirmed only after payment is received.
InnovOak reserves the right to deny participation where payment has not been completed.
13. Refund Policy
Registration fees are generally non-refundable except as outlined below.
If a cancellation request is received at least 30 days prior to the Program start date, a refund may be issued less an administrative fee: 35% of the Program fee or $100, whichever greater.
Cancellations received within 30 days of the Program start date are non-refundable.
No refunds will be issued for: absences, illness, late arrivals or early departures, dismissal for behavioural or safety reasons, missed days.
14. Program Changes and Cancellation
InnovOak reserves the right to modify schedules, activities, staffing, program locations when necessary to maintain program quality or ensure participant safety.
InnovOak may cancel or modify the Program due to circumstances including but not limited to: insufficient enrollment, staffing limitations, facility issues, severe weather, public health directives, other circumstances beyond the School’s reasonable control. Where cancellation occurs prior to the start of the Program, a refund will be provided.
15. Field Trips and Off-Site Activities
Program activities may include supervised off-site activities, field trips, or use of facilities outside the primary Program location.
By registering for the Program, Parents/Guardians acknowledge and consent to participation in such activities where they form part of the Program.
Transportation may occur by walking, school-arranged transportation, or other supervised means deemed appropriate by the School.
16. Force Majeure
InnovOak shall not be liable for failure to perform its obligations where such failure results from events beyond its reasonable control, including but not limited to: natural disasters, government orders, public health emergencies, facility closures, utility failures, labour disputes.
17. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
18. Entire Agreement
These Terms constitute the entire agreement governing participation in the Program and supersede any prior representations or agreements related to the Program.
19. Acceptance
By registering a participant for the Program, the Parent/Guardian confirms that they:
have read and understood these Terms and Conditions,
agree to be legally bound by them,
authorize the participant to participate in Program activities.
